01Acceptance
Agreement to these terms
These Terms form a legal agreement between you and Modern Deployment LLC regarding your access to and use of our websites, software, hosted tools, APIs, client deliverables, and related services.
By accessing, browsing, purchasing, using, or interacting with any Modern Deployment product or website, you agree to be bound by these Terms and acknowledge our Privacy Policy.
02Use of Services
What we provide
Modern Deployment builds and operates a variety of digital products and services, including websites, internal tools, public-facing software, engineering automations, hosted utilities, consulting workflows, integrations, and project-specific client solutions.
Some services are experimental, some are client-specific, and some are public. You may use our services only in compliance with applicable law and in a way that does not interfere with our systems, our clients, or other users.
ℹ️
Broad coverage by designBecause every Modern Deployment website or tool may point back to this page, these Terms are intentionally written to cover a wide range of products, use cases, and delivery models.
03Accounts
Accounts, access, and credentials
Some Modern Deployment services may require an account, email verification, payment record, invite-based access, API credentials, or other authentication mechanisms.
You are responsible for maintaining the confidentiality and security of your login credentials, email access, API keys, and any linked third-party systems used with our products.
04Content & Ownership
Your content and our platform
You retain ownership of content, files, data, prompts, documents, configurations, assets, and materials you submit to a Modern Deployment service, except to the extent ownership is transferred by a separate written agreement.
You grant us a limited, non-exclusive license to host, process, transmit, display, transform, and store that material solely as necessary to operate, secure, maintain, improve, and support the relevant service.
All rights in our software, interfaces, branding, design systems, automation logic, source code, and platform materials remain with Modern Deployment LLC or its licensors unless we explicitly state otherwise in writing.
05Payments
Purchases, invoices, and billing
Some Modern Deployment services are free, some are custom-quoted, and some may be offered under subscriptions, retainers, one-time project fees, usage-based pricing, or other billing arrangements.
If you purchase a paid service, you agree to pay the applicable fees, taxes, and related charges under the pricing or proposal presented to you. Third-party payment processors may apply their own terms and privacy practices.
06Restrictions
Prohibited conduct
You agree not to:
- Use our services for unlawful, abusive, fraudulent, deceptive, or harmful activity.
- Attempt to gain unauthorized access to systems, data, accounts, or infrastructure.
- Upload malware, destructive code, spam, or content intended to disrupt service operation.
- Scrape, reverse engineer, decompile, or copy protected parts of our software except where applicable law clearly permits it.
- Use our services in a way that violates another party’s rights, contracts, policies, or intellectual property.
07Availability
Service changes and uptime
We may modify, suspend, replace, restrict, or discontinue any feature, service, route, workflow, or product at any time for maintenance, product evolution, client requirements, operational reasons, or legal compliance.
Unless we explicitly agree otherwise in writing, we do not guarantee uninterrupted availability, error-free performance, or permanent support for any specific product or feature.
08Disclaimers
No warranty
To the fullest extent permitted by law, Modern Deployment services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.
We do not guarantee that every service will be uninterrupted, perfectly secure, error-free, fit for a particular purpose, or appropriate for every jurisdiction, industry, or compliance environment.
⚠️
Practical versionWe build useful things, but software can be weird, integrations can break, vendors can fail, and users can do surprising things. Please use common sense and appropriate professional review where stakes are high.
09Liability
Limitations of liability
To the maximum extent permitted by law, Modern Deployment LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, data, goodwill, revenue, business opportunity, or business interruption arising out of or related to your use of our services.
To the extent liability cannot be excluded, our aggregate liability for a claim will not exceed the greater of the amount you paid us for the specific service in the three months preceding the event giving rise to the claim, or 100 U.S. dollars.
10Termination
Suspension or termination
We may suspend, limit, or terminate access to a service if we reasonably believe you violated these Terms, created risk for us or others, failed to pay required fees, misused the service, or engaged in conduct that threatens users, clients, systems, or infrastructure.
You may stop using our services at any time. Sections that by their nature should survive termination will continue to apply, including ownership, payment obligations, disclaimers, liability limits, and dispute-related provisions.
11Governing Law
Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules, unless a different governing law is required by a separate written agreement for a specific project.
Before filing a formal legal claim, you agree to make a good-faith effort to contact us and try to resolve the issue informally first.
